§ 7-2. Citations of ordinance violations.

  • The department of development services and the fire department are hereby granted authority to issue citations returnable to city court or to other proper authority for violations of any of the ordinances which are enforced by such department and such citations shall have the same full force and effect as if issued by the police department of the city.

    (1)

    Citation as notice to person responsible. Whenever the code official determines that there has been a violation of a city code or ordinance or has grounds to believe that a violation has occurred, a citation shall be given in the manner prescribed below to the person or persons responsible for the violation as specified in this code.

    (2)

    Form. Such citation prescribed in section 7-2(1) shall be in accordance with the following:

    a.

    In written form.

    b.

    Identifying the property location of the violation.

    c.

    Identifying the code section violated.

    d.

    Providing a date for appearance in municipal court.

    (3)

    Method of service. Such violation shall be deemed to be properly served if a copy thereof is:

    a.

    Delivered personally;

    b.

    Sent by mail addressed to the last known address; or

    c.

    Posted in a conspicuous place in or about the structure or property affected by the citation.

    (4)

    Alternate form of citation. At the discretion of the director of development services or designee, notice may be given identifying violations and required corrective actions in greater detail, and providing a deadline for re-inspection rather than an immediate court appearance date.

    (5)

    Repeat violations. Notice shall not be required if the person responsible has been notified of a previous violation of the same code section.
