§ 15-110. Citation; penalties.

  • Any citizen in violation of this article shall be issued a written citation by a Tupelo police officer while on the site of such violation. The citation for the first offense will direct the violator to secure a permit on the first business day following the date of the violation and to pay the prescribed fee for said permit. Citations for the second and any subsequent violations will direct the violator to make payment of a fine in the amounts described herein, within five (5) days of the date of the citation and made payable to the Tupelo Municipal Court. A violator will be subject to a twenty-five dollar ($25.00) fine for the second offense. A fifty dollar ($50.00) fine will be imposed on the violator for the third offense and a one hundred dollar ($100.00) fine will be imposed for the fourth offense. A violator who receives four (4) citations in one (1) calendar year will be prohibited from holding a garage or other home sale for a period of twelve (12) months following the fourth citation. A violator under this article who does not pay a fine or secure the permit as provided herein will be subject to a hearing before the municipal court for further action and for disposition.
