§ 13-58. Exceptions.

  • The following areas shall not be subject to the smoking restrictions of this article:

    (1)

    Up to twenty (20) percent of all rooms that are rented to guests in bed and breakfast facilities, hotel and motel rooms may be designated as smoking rooms.

    (2)

    Private clubs that have no employees, except when being used for a function to which the general public is invited.

    (3)

    Private residences except those being used for a child care, adult day care or healthcare facility.

    (4)

    Retail tobacco stores.

    (5)

    Retail electronic cigarette stores: provided however, that such stores may only permit the use of electronic cigarettes.
